These Terms & Conditions (“Terms”) govern the booking and use of tours, transfers, and travel services (“Tours”) offered by Tourist Perú (“we,” “us,” “the Tour Operator”). By making a booking, paying a deposit, or participating in a Tour, you (“you,” “the Traveler”) agree to be bound by these Terms.
A booking is confirmed once we issue written confirmation after receiving the applicable deposit or full payment. Please review your confirmation carefully and report any errors immediately — names must match your passport exactly, as this affects entry permits (e.g., Inca Trail) and transport bookings.
Many of our Tours involve physical activity, high altitude, uneven terrain, extended walking or trekking, and travel through remote areas with limited access to emergency services. By booking a Tour, you acknowledge that these activities carry inherent risks, including but not limited to altitude sickness, injury, and illness, and that you are choosing to participate with full knowledge of this.
You confirm that:
Travel insurance is strongly recommended for all Travelers and, for high-altitude treks (e.g., Inca Trail, Salkantay, Choquequirao), we recommend confirming your policy covers medical evacuation and rescue. We are happy to provide documentation of an incident to support an insurance claim.
We select our guides, drivers, and staff carefully, and we are responsible for their conduct while performing their duties for us, in accordance with Peruvian law.
Some services included in a Tour — such as hotels, restaurants, internal flights, or specialized local operators in certain regions — are provided by independent third parties rather than directly by Tourist Perú. If an issue arises with one of these third-party services, we will assist you in resolving it and, where applicable, in pursuing a claim against the responsible provider, in accordance with applicable Peruvian consumer protection law.
Nothing in these Terms is intended to exclude or limit any liability, right, or remedy that cannot lawfully be excluded or limited under the laws of Peru, including the Código de Protección y Defensa del Consumidor.
Some circumstances are beyond our control, including extreme weather, natural disasters, landslides, road closures, strikes, civil unrest, protests, or government action. When these affect a Tour, we will make reasonable efforts to keep you informed, offer a safe alternative itinerary or reschedule where possible, and handle refunds for the affected portion of the Tour fairly and in line with applicable consumer protection law, taking into account costs we have already incurred on your behalf.
We may need to adjust a Tour’s itinerary, schedule, accommodations, or transport arrangements for safety reasons or due to circumstances beyond our control. When this happens, we will inform you as soon as reasonably possible and aim to offer an equivalent or better alternative.
Cancellations, refunds, and rescheduling by the Traveler are governed by our Cancellation Policy, which forms part of these Terms.
For Tours that require third-party permits issued in your name (such as Inca Trail permits), the deposit or fee covering that permit is generally non-refundable once the permit has been issued or purchased on your behalf, since this reflects a real cost already incurred with a government or third-party entity — this will always be clearly stated to you before you pay.
We may ask a Traveler to leave a Tour if their behavior seriously endangers themselves, other Travelers, our staff, or third parties, or is illegal, or seriously disrespectful of local communities and customs. In such cases, any refund will be assessed based on the circumstances and in line with applicable consumer protection law.
Travelers are responsible for ensuring they hold valid passports, visas, and any permits required for their Tour, and for meeting any health requirements applicable to their destination. If a Traveler is denied entry, participation, or boarding due to inadequate documentation, we will help where we can, but cannot guarantee a resolution or refund in that situation.
We recommend that Travelers keep valuables, important documents, medication, and irreplaceable items with them rather than in transported or checked baggage. We will take reasonable care of belongings entrusted to our staff or vehicles.
We may take photographs or videos during Tours for promotional use on our website and social media. If you prefer not to be included, please let your guide know at the start of the Tour.
These Terms are governed by the laws of the Republic of Peru. If a dispute arises, we encourage you to contact us directly first so we can try to resolve it. Nothing in these Terms limits your right to bring a complaint before INDECOPI (Peru’s consumer protection authority) or another competent authority applicable to your situation.
We may update these Terms from time to time. The version in effect at the time of your booking will apply to that booking.
